1. INTRODUCTION

When you provide your personal data to MACKMYRA SVENSK WHISKY AB or any of its subsidiaries (“Mackmyra”) you should feel safe. Your privacy is important to us. We will therefore ensure that personal data collected about you are stored and processed safely and securely, and in compliance with the provisions of the Swedish Data Protection Act and the data protection reform (General Data Protection Regulation) that enters into force in the EU in May 2018. This text explains how Mackmyra handles your personal data and what rights you have. We therefore ask you to carefully read the information below. 2. WHAT ARE PERSONAL DATA?

Personal data is all information that can be directly or indirectly linked to you. Examples of personal data include name, images, social security number, e-mail address, IP address or purchase history.

3. WHAT PERSONAL DATA DO WE PROCESS AND WHY?

In this section we explain how your personal data are used so that we will be able to complete entered agreements, maintain effective cooperation with partners, and provide you with information and offers based on your previous purchases, or which we believe you are interested in based on your actively expressed previous interest in our products, experiences or newsletter.

3.1 WHEN YOU REGISTER PERSONAL DATA WITH MACKMYRA IN CONNECTION WITH PURCHASING PRODUCTS OR EXPERIENCES, ENTER CONTESTS THAT WE ARRANGE, OR CONTACT MACKMYRA’S CUSTOMER SERVICE.

– We save the personal data that are necessary for the purpose of administering and delivering what you have purchased in accordance with our terms of purchase, or shown interest in, as well as to provide you with information and offers that we believe are of interest to you.

– Necessary personal data may include: name, social security number, e-mail address, postal address, telephone number, details of your purchase history.

– We save your personal data based on the performance of a contract until the product or experience you purchased has been delivered, or until the agreement between us has expired, or until the contest you registered for has ended. After that we save a selection of necessary personal data based on a balance of interests when we have a legitimate interest in using your data for statistics and to market our products and services, ensure payment and prevent fraud. You may choose at any time to change your settings or completely unsubscribe from further marketing mailings from Mackmyra via the Mackmyra website.

– We save your personal data for up to 12 months after there is no longer a relevant need for saving them, in acordance with the above paragraph, including as a basis for any complaints. Your purchase history is saved for up to 7 years for our legitimate interest in analysing trends over time.

3.2 WHEN YOU REGISTER PERSONAL DATA WITH MACKMYRA IN CONNECTION WITH registration on MACKMYRA’S “FATWEBB” (website for cask owners)

– We save the personal data that are necessary for the purpose of administering and delivering what you have purchased in accordance with our terms of purchase, or shown interest in, as well as to provide you with information and offers that we believe are of interest to you.

– Necessary personal data may include:  Name, e-mail address, postal address, telephone number and your password to “fatwebben” (website for cask owners).

– We save your personal data based on a balance of interest when we (and you) have a legitimate interest in facilitating reservations for cask tasting, cask owner activities, bottling, etc., and to use your data for statistics and to market our products and services. You may choose at any time to change your settings or completely unsubscribe from further marketing mailings from Mackmyra via the Mackmyra website.

– We save your personal data as long as you actively use your login account (up to 6 months after last use) or have another active commitment with us (e.g. cask owner, cask friend or newsletter subscriber). To ensure traceability, we save data about our communication with you for 12 months. Your purchase history is saved for up to 7 years for our legitimate interest in analysing trends over time.

3.3 WHEN YOU REGISTER PERSONAL DATA WITH MACKMYRA IN ORDER TO SUBSCRIBE TO ONE OF OUR NEWSLETTERS

– We save the personal data that are necessary for the purpose of administering and delivering our newsletters and to provide you with information and offers that we believe are of interest to you.

– Necessary personal data may include: Name, e-mail address, telephone number, postal address.

– We save your personal data based on a balance of interests when we have a legitimate interest in using your data for statistics and to market our products and services. You may choose at any time to change your settings or completely unsubscribe from further marketing mailings from Mackmyra via the Mackmyra website.

– We save your personal data until you actively unsubscribe from all marketing from Mackmyra. To ensure traceability, we save data about our communication with you for 12 months after you have chosen to unsubscribe from all marketing from Mackmyra.

3.4 WHEN YOU PROVIDE YOUR PERSONAL DATA TO US IN YOUR CAPACITY AS A REPRESENTATIVE OF A COMPANY THAT IS A SUPPLIER TO OR DISTRIBUTOR FOR MACKMYRA.

– In certain cases we save your contact details to be able to maintain effective and efficient cooperation and to be able to provide the company you represent with information and offers that we believe are of interest to the company.

– Necessary personal data may include: Name, e-mail address, telephone number.

– We save your personal data based on a balance of interests when we have a legitimate interest in using your data to maintain effective and efficient cooperation with the company you represent.

– We save your personal data up to 12 months after the relevant need for saving them according to the above paragraph no longer applies, including as a basis for any complaints.

3.6 WHEN WE HAVE A LEGAL OBLIGATION TO PROCESS YOUR PERSONAL DATA.

In addition to what is described in the above paragraphs, in some cases we handle your personal data when we are required to do so by law, for example due to our accounting obligations. When we handle your personal data because we are required to do so by law, we do so based on a legal obligation.

4. HOW LONG DO WE SAVE YOUR PERSONAL DATA?

Your personal data are only stored for as long as it is required to fulfil the purposes, or as long as we are required to store them by law. Then your information is deleted or anonymised securely so that they can no longer be linked to you.

5. TO WHOM DO WE DISCLOSE YOUR PERSONAL DATA?

Mackmyra never sells your information to a third party. However, we may disclose your personal data if it is necessary to be able to administer and deliver what you have purchased in accordance with our terms of purchase, for example if you choose to become a Mackmyra cask owner.

Recipients who handle personal data on behalf of Mackmyra always sign a “Personal Data Processor Agreement” with us in order to ensure that your information is correctly and securely handled.

If you purchase a cask that is stored at one of our satellite warehouses, each local partner associated with the satellite warehouse may provide you with relevant local offers and information.

6. HOW DO WE PROTECT YOUR PERSONAL DATA?

We focus on security because your privacy is important to us. We take measures to protect your data in accordance with the Data Protection Regulation, as well as established guidelines for information security. This means that we have rules and procedures on data protection; for example, that we send your information securely and ensure that the staff only have access to the information they need to perform their work. We also log events in our IT systems and archive data without searchability when your personal data must be stored for an extended period of time (for example, according to the Accounting Act).

8. HOW TO OPT OUT OF DIRECT EMAIL MARKETING.

Mackmyra Svensk Whisky may use your e-mail address or your mobile phone number for direct marketing. You are entitled to receive information about the personal data stored with us about you. In addition, under the statutory terms, you may request correction of incorrect data, data limitation or deletion of your personal data. You are also entitled to object to the treatment based on a balance of interests. Regarding treatment based on a contractual relationship between us, you are entitled to request the data transferred to another personal data controller (data portability).
